Delta 8 and delta 9 are both THC, and both are intoxicating. The difference comes down to one chemical bond, how each is made, how strong it feels and how closely the product was tested. Delta 9 is the main THC in the cannabis plant. Delta 8 is usually made in a lab from hemp-derived CBD. Delta 8 is generally described as milder, but that tells you nothing about whether a given product is clean or accurately labeled.

TL;DR

  • Delta 8 and delta 9 have nearly identical structures. They differ in where one double bond sits: the eighth carbon for delta 8, the ninth for delta 9.
  • Small controlled studies found delta 8 acts like delta 9 but less intensely. Both can impair judgment and coordination.
  • Cannabis naturally contains far more delta 9. Delta 8 is most often a manufactured product, so purity and labeling vary widely.
  • Legal status depends on where you are and where the product comes from, and the rules for hemp-derived THC have been shifting. Check current law before you buy.
  • Whatever you choose, read the label and the lab report first. Adults 21+ only.

What is the difference between delta 8 and delta 9?

THC stands for tetrahydrocannabinol. It is a family of related molecules, and delta 8 and delta 9 are two members. Michigan’s Cannabis Regulatory Agency explains that they have similar chemical structures. Delta 8 has its double bond on the eighth carbon of the chain, and delta 9 has it on the ninth.

That small shift matters for three reasons.

  1. Origin. Cleveland Clinic notes that cannabis naturally contains much higher levels of delta 9. Delta 8 is most often sold as a manufactured product made from hemp-derived CBD and other chemicals.
  2. Strength. Delta 8 is generally reported to be less intense.
  3. Oversight. Delta 9 products from licensed cannabis retail typically go through state-mandated testing. Delta 8 products made by chemical conversion may not.

How the effects compare

The research here is thin, so be wary of anyone who claims precision. According to Cleveland Clinic, small controlled studies found that delta 8 effects resemble delta 9 effects but are less intense. Both can impair judgment and coordination, and both can affect memory and thinking. The clinic also says the short- and long-term effects of delta 8 are not fully understood.

The “clearer, less anxious” reputation

Many product pages claim delta 8 gives a clearer head with less anxiety. There is some data behind the reputation. In an online survey published in 2022, delta 8 users commonly reported relaxation and euphoria, 74% said they did not experience anxiety and 83% said they did not experience paranoia.

Treat that as a hint, not a promise. It is a self-reported survey, not a controlled trial. It also tells you nothing about how you personally will react, and nothing about the specific product in your hand.

What people mean by “milder”

Milder does not mean mild. A dose of delta 8 can still be strong for someone with low tolerance, especially in an edible, where effects arrive slowly and last for hours. A few practical habits help with either compound:

  • Start with a small amount and wait. With edibles, that means at least a couple of hours before taking more.
  • Do not drive, and do not combine with alcohol.
  • Check the milligrams per serving, not just the total per package.

If you are new, a lower-dose gummy is a sensible way to learn your own response. Our 10-count 500mg gummies show the per-piece math on the label, which is the number to look at first.

Risks and side effects

Both compounds are intoxicating, and both carry the usual THC risks: impaired coordination, a racing heart for some people, anxiety at higher doses, and trouble with memory and attention. If you have a history of psychosis, are pregnant or take prescription medication, talk with your doctor before using any THC product.

Delta 8 adds a quality problem. The FDA reports that delta 8 products have variable formulations and labeling, and may contain harmful by-products or contaminants from manufacturing. Reported adverse events include hallucinations, vomiting, tremor, anxiety, dizziness, confusion and loss of consciousness. Between December 1, 2020 and February 28, 2022, the agency received 104 adverse-event reports involving delta 8 products, and 55% required intervention or hospital admission. Those are voluntary reports, so they show a pattern, not a rate of harm.

The FDA also says delta 8 products have not been evaluated or approved for safe use.

Drug tests and military service

Neither compound is invisible to a drug test, and “hemp-derived” does not change that. The Department of Defense prohibits delta 8 use by service members, and use may produce a positive military drug-test result. If a test matters to your job, our guide on whether CBD can show up in a military drug test covers the reasoning.

Why testing matters more for delta 8

Delta 9 from the plant is extracted or consumed with relatively little chemistry in between. Delta 8 is typically made by converting hemp-derived CBD, and the FDA warns that potentially harmful chemicals may be used in the process, and that uncontrolled or unsanitary manufacturing can lead to contaminants.

Independent labs have looked closely at what that means in practice:

The lesson is not that every product is bad. It is that a lab report is only worth something if you can read it critically.

How to check a product before you buy

  1. Find the batch. The report should match the batch or lot number printed on the package, not a generic report for the brand.
  2. Look for a full panel. Potency alone is not enough. You want contaminants such as heavy metals, pesticides and residual solvents too.
  3. Compare the numbers. Does the potency on the report line up with the label? Large gaps are a warning.
  4. Check serving size. A label with no milligrams per serving is hard to dose.
  5. Read the fine print on “hemp.” The FDA notes that some delta 8 products labeled simply as hemp products may mislead consumers who associate hemp with being non-psychoactive.

We walk through this in more detail in 3 quick checks to verify cannabis lab results and in four label checks U.S. buyers should do before ordering. If you are weighing THCA against THC, our piece on the 2026 total THC rule explains why the number on the front of a package is not always the number that counts.

There is no single answer, and it is the part of this topic most likely to change while you are reading it.

The short version for the U.S.:

  • Delta 9 from the cannabis plant is governed by state cannabis law. It is legal for adults 21+ in states with adult-use programs, sold through licensed channels, and still illegal under federal law for marijuana.
  • Delta 8 has been sold in a gray area tied to the definition of hemp. Because it is usually made from hemp-derived CBD, sellers have argued it falls outside marijuana rules. Many states have restricted or banned it anyway, and federal hemp rules have been tightening.
  • Michigan’s regulator is clear about its stance: it states that delta 8 products are made with unregulated, chemically synthesized cannabinoids that are often entirely untested, and contrasts them with regulated, tested delta 9 marijuana products.

Outside the U.S., rules differ again by country, so a product that is lawful in one place can be illegal in another. If you travel, do not carry THC products across borders or state lines without checking the rules at both ends.

For current rules where you live, check your state cannabis regulator and the FDA. Do not rely on a retailer’s product page, or on this article, as legal advice. If a legal question affects your job, housing or licensing, ask a lawyer who handles cannabis law.

Which one should you choose?

The right pick depends on what you want and what you can verify.

Choose delta 9 if you want the most familiar, best-studied THC experience, you live where adult-use is legal and you want products that went through state-required testing.

Consider delta 8 if you want something that is usually described as gentler, you are in a place where it is lawful, and you can find a batch-specific, full-panel lab report. A reputable source matters more here than for delta 9.

THC choices pass through legal and testing checks

Skip both, or talk to a clinician, if you are pregnant, under 21, subject to workplace or military testing, or managing a mental health condition.

Format changes the experience too. Vapes hit within minutes and fade faster. Edibles are slow and long. Concentrates are far more potent than flower. Our explainer on live resin versus distillate is useful if you are choosing a vape or dab, and if you use cartridges, read our vape battery safety rules.

Our perspective

We have been serving New York City adults since 2011, and the question we hear most is some version of this one. Our honest view is that the debate over delta 8 versus delta 9 is less important than the debate over verified versus unverified. A tested product from a source you trust beats an untested product of either kind.

That is why we point customers to lab results and clear labels before anything else. If a brand can’t show you a batch report, or the numbers on the package don’t add up, we’d rather you walk away than guess. Price matters, and we aim to keep ours fair, but a cheap vape with an unreadable label is not a bargain.

If you are new, start low and go slow, whichever compound you choose. If you are experienced, read the report anyway. Labs and batches vary, and the people who enjoy cannabis longest are usually the ones who stay curious about what is in it.

FAQ

Is delta 8 stronger than delta 9?

No. Small controlled studies found delta 8 produces effects similar to delta 9 but less intense. Even so, a large dose of delta 8 can still impair you, and products vary in actual content, so don’t assume a weaker experience.

Will delta 8 or delta 9 show up on a drug test?

Assume yes. Both are THC, and use may produce a positive result on a drug test. The Department of Defense prohibits delta 8 for service members, and many employers have similar policies. If a test is coming, ask your employer about its policy and avoid both.

Is delta 8 safer than delta 9?

Not necessarily. Delta 8 may feel milder, but the FDA warns about variable labeling and possible contaminants from manufacturing, and it has not evaluated delta 8 products for safe use. Delta 9 from licensed, tested sources is generally easier to verify.

No. Its status depends on your state and on federal hemp rules, which have been changing. Some states restrict or ban it. Check your state regulator and current federal guidance before buying or traveling with it.
