1. Agreement to Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“Customer,” “you,” or “your”) and High Fashion Smokes & Prints LLC (“HFSP,” “we,” “us,” or “our”), a licensed cannabis delivery business operating under New York State law. By accessing or using our website at www.highfashionsmokesandprints.com or placing any order for delivery, you agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, please do not use our website or services.

2. Eligibility

To use our services, you must:

• Be at least 21 years of age
• Be located within our licensed delivery service area in New York City at the time of ordering
• Provide accurate, current, and complete information when placing an order
• Present valid, government-issued photo identification (e.g., driver’s license, passport, NYC ID) to our delivery personnel upon receiving your order
• Not be prohibited by any applicable law from purchasing or possessing cannabis

We reserve the right to verify your age and eligibility at any point during the ordering or delivery process and to refuse service to anyone who fails to meet these requirements.

3. Legal Compliance

HFSP operates under the New York State Marihuana Regulation and Taxation Act (MRTA) and New York State Office of Cannabis Management (OCM) guidance.

Cannabis remains illegal under federal law. Our service is available exclusively within New York City and only to individuals who are in New York State at the time of purchase. It is your responsibility to understand and comply with all applicable local, state, and federal laws regarding the purchase, possession, and use of cannabis in your jurisdiction.

4. Delivery Service

Service Area

We deliver within New York City. Delivery availability and fees vary by borough and ZIP code. You may check your delivery eligibility and applicable fees on our website before checkout.

Delivery Schedule

We offer two daily menus with the following delivery windows:

• Day Menu (8AM – 8PM): Scheduled deliveries at 10:30 AM, 12:30 PM, 2:30 PM, 4:30 PM, 6:30 PM, and 8:00 PM
• Night Menu (8PM – 2AM): Available Wednesday through Sunday. Scheduled deliveries may vary.

Delivery windows are estimates and may be affected by traffic, weather, high order volume, or other circumstances outside our control. We will make reasonable efforts to notify you of any significant delays.

Delivery Requirements

All deliveries require a valid, government-issued photo ID to be presented at the door. If no qualifying adult is present at the delivery address at the time of delivery, the order may be returned and you may forfeit the delivery fee. We cannot leave packages unattended or deliver to anyone under 21.

Delivery Fees

Delivery fees are clearly disclosed before you complete your order. Your first delivery is free in Brooklyn and Queens within 5 miles. Subsequent delivery fees vary by borough and delivery distance and are displayed at checkout.

5. Orders, Pricing, and Promotions

Order Placement

All orders must be placed through our website or authorized channels. By submitting an order, you authorize us to process payment and initiate delivery. Order confirmations are sent via email and/or SMS. We reserve the right to cancel any order at our sole discretion, in which case you will receive a full refund.

Pricing

Prices are listed in U.S. dollars and include applicable New York State cannabis taxes unless otherwise stated. Prices are subject to change without notice. The price displayed at checkout is the final price charged, absent error.

Promotions and Deals

We may offer weekly promotional deals, a rewards program, a referral program, and a free gift with every scheduled order. Promotional offers are subject to availability and may be modified or discontinued at any time without notice.

• Upon available, we offer weekly deals (Sunday-Thursday): Soda Sunday, Mix Combo Monday, Trippy Tuesday, Winner Wednesday, Tasty Thursday. Each deal is capped at 20 spots per day (Winner Wednesday has 3 prize winners). Friday and Saturday are full-menu only with no promotional deal caps.
• First Delivery Free: Available to first-time customers. Limit one per customer. May not be combined with other delivery fee promotions.
• Referral Program: Credits are issued only after the referred customer completes a qualifying first purchase.

6. Payment

We accept payment through the methods displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full order amount including any applicable taxes and delivery fees.

Due to federal banking restrictions on cannabis businesses, not all conventional payment methods may be available. Available payment options are clearly listed at checkout. All transactions are final at the time of payment unless cancelled per our cancellation policy.

7. Cancellations

You may cancel an order at no charge before it has been prepared and dispatched for delivery. Once an order has been confirmed for dispatch, cancellation may not be possible. 8. Prohibited Uses

You agree not to:

• Use our services if you are under 21 years of age
• Resell, redistribute, or commercially exploit any products purchased from us without our express written consent
• Provide false, misleading, or inaccurate information at any point during the ordering or delivery process
• Attempt to transport any products across state or federal jurisdictional boundaries
• Use our website in any manner that could damage, disable, overburden, or impair it
• Attempt to gain unauthorized access to any part of our website or systems
• Use our services for any unlawful purpose or in violation of any applicable laws or regulations

9. Intellectual Property

All content on our website – including text, graphics, logos, images, product names, the “High Fashion Smokes & Prints” name and branding – is the property of HFSP or its licensors and is protected by applicable intellectual property laws. You should consult a qualified healthcare professional before using cannabis products, particularly if you have a medical condition, are pregnant, or take prescription medications.

Product Availability: Products displayed on our website are subject to availability. We reserve the right to substitute comparable products if an item is out of stock and will notify you before dispatching any substitution.

11. Limitation of Liability

To the fullest extent permitted by applicable law, HFSP and its owners, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to loss of revenue, data, or profits. Our total liability to you for any claim arising from your use of our services shall not exceed the total amount you paid to us in the 30 days preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless HFSP and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your violation of these Terms or applicable law, your use of our services, or your infringement of any third-party rights.

13. Dispute Resolution

These Terms and any dispute arising from your use of our services shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law provisions. Any legal action or proceeding relating to your use of our services shall be brought exclusively in a court of competent jurisdiction in Brooklyn, New York.

We encourage you to contact us directly to resolve any disputes before initiating formal legal proceedings. Most concerns can be resolved quickly through our customer service team.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted to this page with a new “Last Updated” date. Your continued use of our services after any changes constitutes your acceptance of the updated Terms.
